The answer is yes—but with important conditions and steps that must be followed carefully to remain in legal status and continue working in Canada.


🔍 Understanding LMIA-Based Closed Work Permits

A closed LMIA-based work permit ties you to:

  • A specific employer

  • A specific position

  • A specific location

This means you are not legally allowed to work for another employer unless you obtain a new work permit first.


✅ Can You Switch Employers?


Yes, but you must apply for a new work permit supported by:

  • A new job offer

  • A new positive LMIA (from the new employer)


You cannot start working for a new employer until:

  1. You’ve submitted a new work permit application; and

  2. You’ve received authorization to work (either interim work authorization or the new permit itself).


🔄 The Process to Change Employers


Here are the steps to legally switch employers:


1. Secure a New LMIA Job Offer

Your prospective employer must:

  • Advertise the position according to IRCC guidelines

  • Apply for and receive a positive LMIA from ESDC


2. Apply for a New Work Permit

Once the new LMIA is approved, you must:

  • Apply for a new closed work permit (online or via flagpoling)

  • Include the new LMIA and job offer


3. Wait for Work Authorization

  • If you apply inside Canada and hold valid status, you may be eligible for interim work authorization under IRPR section 199, allowing you to start the new job after submission

  • Otherwise, you must wait for the new permit approval


⚠️ Risks of Switching Without Authorization


Switching employers without following the proper process can result in:

  • Violation of permit conditions

  • Inadmissibility for unauthorized work

  • Future immigration refusals


💡 Can You Change Employers with an Open Work Permit?


If you hold an open work permit (e.g., spousal or PGWP), you can switch employers anytime without needing a new LMIA or permit, as long as the job complies with your permit conditions.
